- The RENTER shall keep and maintain the rented equipment during the terms of the rental at his/her own cost and expense. RENTER shall keep the equipment in a good state of repair, normal wear and tear excepted.
- The RENTER shall pay the MN Tru North full compensation for replacement and/or repair of any equipment which is not returned because it is lost or stolen or any equipment which is damaged and in need of repair to put it into the same condition it was in at the time of rental, normal wear and tear excepted. MN Tru North’s invoice for replacement or repair is conclusive as to the amount RENTER shall pay under this paragraph for repair or replacement.
- Rental rate is charged by MN Tru North, rental charges are billed to the RENTER for each period or term from the time the equipment is in the renters possession until its return. RENTER will be billed for the full term even if the equipment is returned before the end of the term. If the equipment is not returned during or at the end of the term, then the rental charges shall continue on a full-term basis for any additional term thereof until the equipment is returned.
- No allowance will be made for any rented equipment or portion thereof which is claimed not to have been used. Acceptance of returned equipment by MN Tru North does not constitute a waiver of any of the rights MN Tru North has under the rental agreement.
- If RENTER would like to retain equipment for longer than their originally agreed upon term, RENTER must notify MN Tru North prior to the end of their term for approval.
- MN Tru North makes no warranty of any kind regarding the rented equipment, except to replace the equipment with identical or similar equipment if the equipment fails to operate in accordance with the manufacturer’s specifications and operation instructions. Such replacement shall be made as soon as practicable after RENTER returns the non-conforming equipment.
- RENTER indemnifies and holds MN Tru North harmless for all injuries or damage of any kind for while RENTER has possession or is using the rented equipment.
- RENTER understands that they are fully capable in all aspects of the handling and operation of the rental equipment and will operate in accordance with all safety rules and regulations.
- RENTER agrees to report any accident, damage or malfunction to Tru North immediately.
- RENTER agrees not to use the rental equipment for any unlawful purposes, not use the equipment in a careless, reckless or negligent manner and will not operate under the influence of alcohol or narcotics.
- RENTER should be aware that Tru North’s ability to provide rental equipment is contingent upon and subject to the return by the previous renter or any other cause beyond the control of Tru North.
- RENTER understands that their deposit may be retained by Tru North as compensation for failing to return the rented item in as good condition (excluding normal wear and tear) as when received; for damaged, missing or broken pieces; or to be applied to rental charges upon return. Example: Re-fuel, delivery/pick-up fees. Retention of deposit may be in addition to any other remedies Tru North may have at law.
- RENTER understands that a 30-day cancellation notice is required and a minimum $150 cancellation fee will apply. No cancellations within 30 days from reserved date.
